Terms of Service

These Terms of Service ("Terms") govern your access to and use of PulseAI (the "Service"), operated by PerformaAI. By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

PulseAI provides tools to plan performance review cycles, collect self and manager feedback, manage organization structure, and support HR verification workflows. Features may change over time as we improve the product.

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Organization owners and admins control who can access their workspace and what roles they hold. You must provide accurate information and promptly update it when it changes.

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes
• Attempt to gain unauthorized access to other organizations' data or systems
• Interfere with or disrupt the Service, including through abuse of APIs or automation
• Upload malicious code or content that infringes others' rights
• Misrepresent your identity or your authority within an organization

You (or your organization) retain ownership of content and data you submit to the Service ("Customer Data"), including employee profiles, review responses, and organization structure. You grant us a limited license to host, process, and display Customer Data solely to provide and improve the Service. You are responsible for having the rights and consents needed to submit Customer Data.

Performance reviews and related workplace data are sensitive. We treat Customer Data as confidential and do not sell it. Access within your organization is controlled by the roles and permissions you configure.

The Service, including software, design, branding, and documentation, is owned by PerformaAI and its licensors. These Terms do not grant you any rights to our trademarks or source code except as needed to use the Service.

We aim to keep the Service reliable but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue features with reasonable notice when practical. We may update these Terms; continued use after changes take effect constitutes acceptance. Material changes will be reflected by updating the "Last updated" date on this page.

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if required for security or legal reasons. Upon termination, organization admins may request export or deletion of Customer Data subject to our retention practices described in the Privacy Policy.

The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. PulseAI is a workflow tool and does not provide legal, HR, or employment advice. To the maximum extent permitted by law, PerformaAI is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising from your use of the Service.
